This indenture made the fourth day of August in ye year of our Lord Christ one thousand seven hundred fifty & two, Between Ephriam Polk of the County of Sussex on Delaware, Planter of the part and Solomon Debity, off the same county, yeoman on the other part, Whereas: There is a certain Tract parcel of land Scituate lying and being in the Forrest of Cedar Creek Hundred in the County of Sussex afsd, commonly called and known by the name of Molly’s Folly, containing about three hundred and forty acres, Which said Land was surveyed to said Ephraim Polk on the Twenty-Eighth day of January Anno Dom. One thousand seven hundred and forty five, by William Shankland, Deputy Surveyor, by Virtue of a Proprietary Warrant dated at Philadelphia the thirteenth Day of May one thousand seven hundred and forty three as by said Warrant & certificate as marked Survey appears Which said tract or parcel of land adjoins unto the Land of Thomas Postels being on the South and Southwest side of said Postels’ Land and on the South East side binding with the land of Dorman Webb And on the north side with the Land or Plantation of Solomon Townsend and a swamp on there west side.
Now this indenture Witnesseth that the said Ephraim Polk for and in consideration of the sum of Eighty pounds Current money of America to him in hand paid by the said Solomon Debity the receipt whereof is hereby acknowledged hath granted Bargained sell A lien Emfoff Released conveyed and confirmed and do by these presents doth give grant Bargain sell Alien Enfoff Release Convey and Confirm unto the said Solomon Debity his heirs and assigns in fee simple the above mentioned Three hundred and forty acres of land be the same more or less together with all known buildings ways easements accreditaments and appurtenances with all woods and or woods and water and water courses orchards fences appurtenances whatsoever there unto belonging or in any wise appurtaining free and clear and freely and clearly acquitted exonerated and discharged off and from all further gifts grants bargains sales leases or mortgages and encumbrances whatsoever the proprietors quotients receipts and forearmed (?) and the above mentioned Ephraim Polk for himself his heirs executors and admrs. The above mentioned land and promises unto the said Solomon Debity his heirs Excrs Admrs and assigns against the lawful claim of him the said Ephraim Polk his heirs & assigns and against the claim of all and every person and persons whatsoever shall and will warrant and forever deffend by these presents, In testimony whereof the said Ephraim Polk hath hereunto set his hand and Seal the day and year first above written.
